Justice Department Defends White House Ban on CNN, Politico, and MS NOW

The US Justice Department has submitted legal documents arguing that three media organizations—CNN, Politico, and MS NOW—should remain barred from the White House, accusing them of spreading “verifiable falsehoods” and producing reporting that compromised national security.

The filing comes ahead of a critical District of Columbia court hearing on Wednesday, where a judge will determine whether to issue a temporary injunction lifting the ban while the case proceeds. President Donald Trump issued the prohibition last week, alleging the outlets were responsible for spreading “fake news,” which resulted in the confiscation of journalists’ credentials and denial of access to the building.

In its defense, the Justice Department provided the White House’s list of “reporting incidents” that precipitated the ban. According to court documents, the grievances include coverage regarding White House construction projects, specifically a new ballroom and a security bunker, as well as a report concerning an internal investigation into information leaks. The filing emphasizes that entry to the presidential residence is a “privilege, not a right.”

The three networks contend that the revocation of press credentials without due process violates the First Amendment’s protection against government interference with a free press. In a joint statement announcing their lawsuit, the organizations asserted, “Without notice or process, the White House revoked our journalists’ credentials because it objected to our reporting.” They warned that allowing such actions to stand unchecked would undermine press freedom and the public’s right to independent journalism.

The conflict has triggered significant shifts in media coverage of the president. Major television networks recently withdrew from the traditional “pool” arrangement, which involves sharing video and photographic coverage of presidential activities. Shortly thereafter, the White House launched Trump TV, a 24/7 streaming channel providing unfiltered clips of the president.

Tensions escalated further on Tuesday before the United Nations General Assembly. President Trump confronted CNN reporter Kaitlin Collins, stating, “I’m surprised that CNN is here covering me. You said you weren’t going to cover me.” Collins clarified on air that the network had never made such a pledge. Trump subsequently criticized Collins on social media and reiterated his characterization of CNN, Politico, and MS NOW as “treasonous.”
