A Honolulu judge has denied a motion for a new trial for Dr. Gerhardt Konig, who was convicted of attempted manslaughter in the attack on his wife during a hike, after determining that jurors were not subjected to outside influence.
Defense attorneys had argued that the verdict’s integrity was compromised by information suggesting a juror communicated with an individual watching a livestream of the proceedings. The anonymous online comment claimed the sender had been texting with a juror about pursuing a count three attempted manslaughter charge.
Judge Paul B.K. Wong summoned all jurors back to court this month for a two-day inquiry to determine if any discussions occurred outside the deliberation room. Each juror testified that they did not engage in such conversations.
“There is no evidence that the jury was subjected to outside influence,” Judge Wong stated in court on Friday. He ruled that the verdict was unanimous and impartial, leading to the denial of the defense’s motion.
The defense also contended that the jury misunderstood the court’s instructions, pointing to media interviews given by two jurors, including the foreperson, after the April verdict. However, Wong noted that Hawaii case law prohibits juror testimony regarding the internal mental processes of their peers. He further observed that every juror affirmed their agreement with the verdict when it was read in court.
Dr. Konig, an anesthesiologist from Maui, is scheduled to be sentenced on January 8, 2027. The attempted manslaughter charge carries a maximum penalty of 20 years in prison. His sentencing was originally set for August but was delayed following the filing of the new trial motion.
Prosecutors alleged that on March 24, 2025, Dr. Konig attacked his wife, Arielle Konig, near a cliff on the Pali Puka Trail on Oahu while celebrating her birthday. The prosecution claimed he pushed her toward the edge and struck her multiple times with a rock.
Although Dr. Konig pleaded not guilty to second-degree attempted murder, the jury convicted him of the lesser charge after several hours of deliberations. Jurors had been instructed to consider assault charges if they could not find him guilty of attempted murder.
During the nearly three-week trial in Honolulu, both spouses took the stand and provided conflicting accounts of the incident. Arielle Konig testified that her husband pushed her toward the cliff edge and beat her with a rock up to ten times, stating she believed he intended to render her unconscious to drag her over the edge.
In his defense, Dr. Konig maintained that he never intended to harm his wife and claimed he acted in self-defense when he struck her with the rock. He has remained in custody since his arrest. Arielle Konig filed for divorce in May 2025, seeking full custody of the couple’s two young children.
