According to recent court filings, Department of Justice attorneys informed opposing counsel in two separate lawsuits that they will provide only 48 hours’ notice before launching the citizenship portal.<\/p>\n
This initiative marks the first time the federal government has attempted to create a comprehensive list of American citizens. Under the U.S. Constitution, maintaining voter rolls is the responsibility of individual states, not the federal government. The project stems from an executive order signed on March 31, which directed U.S. Citizenship and Immigration Services (USCIS) and the Social Security Administration to generate “State Citizenship Lists” and deliver them to state officials at least 60 days before federal elections. Although a lower court initially blocked key portions of this order in 23 states and Washington, D.C., the Supreme Court lifted that injunction late last month, allowing the administration to move forward.<\/p>\n
Jules Torti, counsel at the nonprofit Protect Democracy, warned that the reliance on inaccurate data poses a significant risk of disenfranchisement. “States here have a strong incentive to actually use these lists to try to avoid federal investigation,” Torti told NPR. “But we know that these lists are going to be based on really inaccurate data. The Electronic Privacy Information Center (EPIC), along with individual voters and legal groups, filed a motion in Maryland federal court this Thursday seeking to block the implementation. Furthermore, they note that Social Security records often fail to update when individuals naturalize, and USCIS systems frequently lack records for those who became citizens as minors through their parents.<\/p>\n
The delay in meeting the original deadline has raised concerns about increased confusion for election officials and voters. Torti stated, “It means additional chaos, additional confusion… And I think that’s the point. The point here is to create chaos in advance of the election.” Neither the Department of Justice nor the Department of Homeland Security responded to requests for comment.<\/p>\n
While the portal remains offline, a domain has been secured, and it briefly displayed a “Coming Soon” landing page in recent days. Lawyers for Democratic party groups, who challenged the executive order in a separate April lawsuit, accused the administration of failing to notify the court of its continued progress. They have requested that the judge mandate immediate updates regarding implementation plans.<\/p>\n
This legal battle coincides with broader efforts by the Department of Homeland Security to analyze state voter rolls for potential noncitizen voting, despite previous audits showing such instances to be exceedingly rare.
