The instruction reminded them that it remains their duty to decide the case if they can do so conscientiously.<\/p>\n<p>Legal analysts note that continuing deliberations under these circumstances increases the likelihood of a hung jury. Peter Elikann, a criminal defense attorney based in Boston, described the situation as a critical juncture for the proceedings.<\/p>\n<p>&#8220;At that point, the judge has to declare a mistrial, unless he has the consent of the jury who would want to go out again, and that&#8217;s rather doubtful,&#8221; Elikann told ABC News. &#8220;This is really it. This is kind of the final push.&#8221;<\/p>\n<p>If a mistrial is declared, prosecutors will face several options regarding the future of the case.
