A specialized tribunal in The Hague is set to announce its judgment on Wednesday in the three-year trial of Hashim Thaci, Kosovo’s former president, alongside several top commanders of the Kosovo Liberation Army (KLA). The defendants face charges of war crimes and crimes against humanity allegedly committed during the 1998-1999 independence war against Serbia.
Thaci, who served as the KLA’s political leader, and former high-ranking guerrillas Jakup Krasniqi, Rexhep Selimi, and Kadri Veseli have all entered not-guilty pleas. Prosecutors allege the group murdered more than 100 political opponents and individuals suspected of collaborating with Serbian forces. The charges include counts of murder, torture, and persecution, with prosecutors having sought 45-year prison sentences for each accused.
While prosecutors assert that KLA facilities in Kosovo and Albania were used to hold victims, the defense argues that the senior leadership lacked the strict command structure necessary to control or be held responsible for such actions. Lawyers for the defendants contend there is no direct evidence linking Thaci’s command to the alleged crimes.
Thaci has maintained his innocence throughout the proceedings. “I expect to be acquitted of every charge,” he stated in August. In February, as the trial concluded, he told the judges, “Throughout my life, I stood with the people of Kosovo defending freedom, life and dignity.”
The verdict carries significant weight in Kosovo, where the accused are widely revered as national heroes and symbols of the independence movement. Thaci played a central role in the country’s 2008 declaration of independence from Serbia. In Pristina, thousands of supporters are expected to gather for the livestreamed announcement, following large rallies over the weekend demanding acquittals. A digital countdown clock has been installed in the capital to mark the occasion.
Kosovo Prime Minister Albin Kurti expressed support for the defendants ahead of the ruling. “Our war was just, a war of liberation,” Kurti said. “We believe and hope … that the KLA leaders will return free to their country and to their families.”
Established in 2016 under Kosovo law but based in The Hague, the Kosovo Specialist Chambers (KSC) was created to prosecute alleged KLA war crimes after previous domestic cases failed due to allegations of political interference and witness intimidation. Although staffed by international judges, the tribunal remains deeply unpopular within Kosovo. Of the 15 individuals indicted so far, only three are currently serving sentences.
Thaci resigned the presidency in 2020 after being indicted and has remained in detention in The Hague. He faces a second trial for alleged obstruction of justice, which could result in continued custody even if he is acquitted in the current war crimes case.
