Erik and Lyle Menendez have been granted an early parole suitability hearing, tentatively scheduled for March 2027, according to a ruling released Monday. The decision marks a significant shift for the brothers, who were originally sentenced to life without the possibility of parole for the 1989 murders of their parents, Jose and Kitty Menendez.
The pair were resentenced in May 2025 to 50 years to life, a change that made them eligible for parole consideration. However, their initial request for a hearing in August 2025 was denied by the California Board of Parole. Authorities cited violations of prison rules, including the possession of illegal cellphones, and noted that Erik Menendez had previously been linked to a prison gang. Despite the brothers’ family describing them as model inmates, the board determined they were not suitable for parole at that time.
Relatives of the Menendez brothers had campaigned for years for resentencing and release. In a statement to KABC, the family highlighted the brothers’ efforts over nearly four decades to take responsibility for their actions and address the abuse and trauma they endured.
“We will always be profoundly grateful that they have been resentenced and that our family can now imagine a future in which they are once again part of our everyday lives,” the family said. They also noted that the brothers established a hospice program and launched a beautification project during their incarceration.
The case has drawn intense public scrutiny since its inception. During the original 1993 trials, prosecutors alleged the siblings killed their wealthy parents for financial gain, pointing to a spending spree following the slayings. The defense argued self-defense, claiming the brothers acted to stop years of sexual abuse by their father.
Initial juries deadlocked, resulting in mistrials for both brothers. A second trial in 1996, where the judge restricted much of the sexual abuse evidence, led to convictions of first-degree murder and consecutive life sentences without parole. The recent resentence paved the way for the upcoming March 2027 hearing.
