In its third attempt to secure high court involvement, the Trump administration has petitioned the Supreme Court to intervene in the ongoing legal battle regarding restrictions on mail-in voting before the midterm elections. The filing was submitted on Sunday, merely two days after U.S. District Court Judge Indira Talwani expanded a preliminary injunction blocking the U.S. Postal Service from enforcing President Trump’s executive order on mail ballots for the November elections.
Solicitor General John Sauer argued in the filing that the current judicial pause is creating operational chaos as states proceed with mailing ballots. “Ballots have already begun to be mailed in North Carolina, and more States will begin the mailing process as the injunction remains in place — including Alabama on September 9 and at least five States the week of September 13,” Sauer stated. He emphasized that once envelopes enter the postal system, they cannot be retrieved, and the injunction renders preparatory steps voluntary rather than mandatory, risking “confusion and chaos.”
While the Supreme Court has previously allowed the administration’s plan to proceed without making a final ruling on its legality, election officials and voting rights advocates contend the changes are unconstitutional. Democrats and state authorities argue there is insufficient time to revise systems to comply with new Postal Service directives, such as unique barcodes and an online portal for reporting voter information. Officials have noted that ballot envelopes have already been ordered and printed.
Sauer described the restrictions as “commonsense changes” within the administration’s regulatory power and requested an immediate administrative stay followed by a full stay pending further review. “That will remove the improper cloud of uncertainty… making clear to all involved that compliance with the Rule is not optional and must start without further delay,” he said.
The outcome of this dispute carries significant weight for the upcoming midterms, where control of Congress is at stake and nearly one-third of U.S. voters cast ballots by mail. Despite President Trump’s history of attempting to limit mail voting—despite his own frequent use of the method—and his baseless claims regarding the 2020 election, he has so far been unable to alter the long-standing voting procedure.
