Australia-based online fashion retailer White Fox is facing a lawsuit from global sportswear giant Adidas in the Federal Court. The German company alleges that White Fox is attempting to capitalize on its established reputation by producing garments featuring a four-stripe design that Adidas argues is deceptively similar to its protected three-stripe trademark.
The legal proceedings, filed in Sydney, center on the claim that the Australian label’s use of the four-stripe motif constitutes trademark infringement. Adidas contends that consumers may be confused by the resemblance between the competitor’s branding and its own distinctive logo.
