Court of Appeal to hear residents’ challenge to Drumcree parade ruling

The Court of Appeal is set to consider a legal challenge brought by residents of the Garvaghy Road regarding the authorization of a controversial Orange Order parade in Portadown, Northern Ireland. The hearing is scheduled to begin in Belfast on Monday at approximately 10:30 BST.

The dispute has been ongoing since last Sunday, when residents blocked the proposed route on the predominantly nationalist street, preventing the march from Drumcree Church from proceeding. Protesters have maintained a presence on the road since then, albeit in reduced numbers, while members of the Portadown District Orange Lodge have remained stationed at Drumcree Church, located about a mile away.

Legal representatives for the Garvaghy Road Residents’ Coalition (GRRC) filed a fresh application arguing that the Parades Commission had “materially misdirected itself” concerning police assessments of potential disorder. The application further contends that the commission failed to provide an accurate representation of evidence provided by the Police Service of Northern Ireland (PSNI) in its decision-making process.

This appeal follows a series of legal proceedings that spanned 13 hours over the weekend, culminating in the Parades Commission’s decision on September 25 to permit the march with specific restrictions. Last Sunday’s confrontation reopened tensions reminiscent of the mid-to-late 1990s, a period marked by severe riots, roadblocks, and fatalities associated with the parading dispute.

In the intervening period, efforts to resolve the conflict through dialogue have continued. PSNI Chief Constable Jon Boutcher addressed the issue during a public meeting of the Policing Board in Belfast on Thursday, revealing that the policing operation related to the dispute has already incurred costs of approximately £3m. Boutcher warned of the significant consequences and expenses involved if authorities were to mismanage the situation.

Key figures, including DUP MLA Jonathan Buckley and Orange Order officials Nigel Dawson and Alastair Power, have been seen discussing the matter near Drumcree Church. Meanwhile, Breandán Mac Cionnaith of the GRRC has been actively engaging with residents outside the courthouse following recent legal developments.
