Timeline emerges from Jane Doe’s account of alleged Cornell fraternity assault

Text messages and investigative documents have provided a detailed timeline of the alleged sexual assault that a Cornell University student, identified as Jane Doe, says occurred at a Chi Phi fraternity house in October 2024. The account is derived from messages obtained by CBS News, a lengthy interview transcript with campus police, and records from the university’s Title IX investigation.

Jane Doe, who was 20 at the time of the incident, has filed a civil lawsuit against seven former fraternity brothers, the university, and other parties she alleges failed to protect her. While prosecutors initially declined to file charges, they have since reopened the criminal investigation.

According to the timeline, the events began on the night of Oct. 19, 2024. Jane Doe stated that she consumed vodka until intoxicated at a sorority house before taking an Uber to a downtown Ithaca bar around 8:30 p.m. There, she was allegedly served additional alcohol despite being underage. By 10 p.m., she and other sorority members moved to a second bar.

At approximately 11 p.m., Jane Doe went alone to meet a friend at the Chi Phi fraternity house, where she claims she was drugged and raped by multiple men. The chapter was subsequently shut down by the university in 2024.

During an interview with Cornell police on Nov. 14, Jane Doe stated that she initially engaged in consensual sexual activity with two men she knew, telling investigators, “I was pretty OK with all of this,” while noting she was extremely intoxicated. However, she said the situation escalated rapidly.

Documents indicate that by 1:42 a.m. on Oct. 20, a defendant sent a message in a Snapchat group chat stating there was a woman upstairs for “free” sex. When another brother asked if the “shop is still open,” the response was affirmative. Jane Doe alleges that some men forced her to take ketamine until she was completely incapacitated and then forced sex upon her.

In a sworn statement, Jane Doe explained that she considered taking more ketamine to pass out, believing that if she was unconscious, the acts would clearly constitute rape. She described hiding under covers in bed as more men entered the room, stating, “I was like literally cornered… what the [expletive] is happening?” She lost consciousness around 5:45 a.m.

After awakening, Jane Doe returned to her sorority house. Documents from the Title IX investigation reveal that she discussed the events with roommates the following morning. One roommate recalled Jane Doe laughing but appearing to be in shock, not initially labeling the incident as rape or assault. A second roommate said Jane Doe told her, “I wasn’t comfortable.”

The day after, she spoke with her sorority “big sister,” warning her that rumors about her were true but that she had not yet processed what happened.

On Oct. 22, Jane Doe visited Cornell Health for a urinary tract infection and was tested for sexually transmitted diseases. Her lawyer, Thomas P. Giuffra, stated that she disclosed the UTI was contracted in a “traumatic way,” but the medical professional only advised her to “speak with somebody” and did not immediately refer her for a rape kit. Giuffra noted that by the time she received a forensic exam on Nov. 7, DNA evidence was no longer available.

Text messages obtained by CBS News New York investigative reporter Mahsa Saeidi show communications between Jane Doe and one of the accused just days after the alleged assault. The man apologized for “how things went down,” claiming his memory was fuzzy and that he and another brother were too intoxicated to intervene. Jane Doe replied that her memory was also “super clouded” and wrote that “non(e) of the sexual stuff was illegal,” adding that she liked being with him and another man.

By Oct. 23, Jane Doe texted a friend she met at the fraternity house, saying the episode was “RUINING my life temporarily” and that she could only “sleep and cry all day.” The friend responded that she had nothing to be ashamed of.

About a week later, Jane Doe said she saw online forum comments referencing a sophomore who had been gang-raped by Chi Phi members, which she said helped her realize the severity of what happened. Around this time, a roommate reported hearing Jane Doe tell one of the men, “You had penetrative sex with me. I had so much ketamine, my eyes were crossed, and you still had sex with me.”

On Nov. 3, after learning she had been disinvited from a Halloween party, Jane Doe texted, “let’s be clear that 90% of what happened that night was not consensual.” Another message cited in reports indicated she felt like a “sex doll/worker.”

Jane Doe underwent a sexual assault forensic exam on Nov. 7 at an Ithaca hospital. On Nov. 8, she reported the alleged gang rape to Cornell University Police. That same day, the Xi Chapter of Chi Phi was placed on suspension, and the seven men named in the lawsuit were temporarily suspended.

During her Nov. 14 police interview, Jane Doe stated, “I can say with 100% confidence I was raped.” She recounted gaps in her memory and described feeling coerced and physically hit. On Nov. 15, she reviewed and signed a revised six-page statement, telling investigators, “I’m very confident about this.”

Cornell’s internal review resulted in two men being expelled, two suspended for at least two semesters, one escaping punishment because he had already graduated, and two found not responsible for sexual misconduct. Jane Doe subsequently dropped out of school.

On Sept. 16, 2026, nearly two years after the incident, Jane Doe filed her civil lawsuit. Five days later, Tompkins County District Attorney Matthew Van Houten confirmed the reopening of the criminal investigation. Van Houten told CBS News that he had not previously seen the interview transcript in which Jane Doe expressed absolute confidence in her allegations.
