Defense Attorney Questions Evidence in Clancy Murder Case Amid Strategy Shift

In a notable development during the post-mistrial proceedings for Lindsay Clancy, her attorney Kevin Reddington contended on Tuesday that there is insufficient evidence to prove his client murdered her children. The argument was made during a hearing following the announcement of a mistrial in early September after the jury failed to reach a verdict.

Reddington filed a renewed motion for a required finding of not guilty, asserting that the prosecution had not met its burden of proving guilt beyond a reasonable doubt. He challenged the court, asking repeatedly, “Where is the evidence that she did this?” and stating that the entire case relied on speculation rather than proof that Clancy admitted to the killings.

The motion also addressed the issue of criminal responsibility. Reddington explained to the judge that the defense faced a conundrum because it was being asked to admit culpability in order to argue a lack of criminal responsibility. He argued that prosecutors failed to prove both that Clancy committed the acts and that she was criminally liable.

This legal strategy appeared to contradict Reddington’s stance during the original trial. In opening statements in July, he had stated that Clancy “knows what happened to those kids.” Additionally, during a pretrial hearing in June, Reddington remarked that she takes responsibility and “owns it,” calling the situation an extreme tragedy. An April 2026 motion had also seen Reddington offer to stipulate in writing that Clancy admitted to killing her children, though that request to bifurcate the trial was denied.

Plymouth District Attorney Tim Cruz confirmed to reporters outside the courtroom that his office is conducting a thorough review of the case to determine the best interest of justice. Prosecutors have not yet explicitly confirmed plans to retry Clancy.

Legal analyst Jennifer Roman described the sudden shift in defense strategy as “very unusual” and “bizarre,” noting the significant change in approach regarding whether Clancy actually killed her children. Some analysts suggest the move may be an attempt to deter prosecutors from seeking a second trial.

The next hearing in the matter is scheduled for November 2.
